Justice Breyer Having a Cow

In the wake of the Supreme Court decision strongly discouraging race-based assignment plans in public schools, and other decisions issued by the Roberts court, Justice Steven Breyer has been thrown off balance.  After a half-century of liberal legislating by the Supreme Court, things are now a bit different.  And Breyer doesn't like it one bit.

During the reading of the decision affecting the public schools, Breyer reportedly was beside himself, shaking his head, rolling his eyes and grimacing overtly.

And he reportedly pigeonholed Senator Arlen Specter at a festival in Colorado complaining that recent nominees to the Supreme Court misrepresented themselves during their confirmation hearings.  At issue is the degree to which Justices Roberts and Alito are bound to refrain from reversing precedents that represent liberal policymaking, often enacted through judicial activism.

Justice Breyer is having a difficult time adjusting to the new realities.   It has not yet been reported whether he has had to go on medication.

Judge Breyer is an embarassment to the Supreme Court but his discomfort is good news. We have Bill Clinton to thank for this liberal activist who wants to legislate from the bench.

He is in the same league with hiz honor Judge "Crying " Larry Seidlin, of Anna Nicole Smith fame.

Fred, Justice Breyer is now going through the various stages of grief. It will take a while for him to process what is happening to him. In the meantime, his family and his fellow Justices will need to help him get through it.
